1. General
1.1 Charity.
Donations go to Airbnb.org, Inc., an independent nonprofit organization recognized by the U.S. Internal Revenue Service under Section 501(c)(3) of the U.S. Internal Revenue Code as a tax-exempt public charity (Federal Tax ID: 83-3135259) (“Airbnb.org”). Airbnb.org helps connect people with temporary accommodation in times of crisis caused, for example, by conflict or disaster.
1.2 Ways to Donate.
There are multiple ways to donate to Airbnb.org. You (“you” or “Donor”) may make a donation (“Donation”) using the donation feature on the Airbnb Platform (the “Airbnb Donation Platform”), either as a one-time donation (“One-Time Donation”) or, if you are a Host, on an ongoing basis (“Ongoing Donation”). Your Donation will be processed by Airbnb Payments in accordance with the Payments Terms. Airbnb Payments may pay any Donations you make to Airbnb.org directly or through an intermediary (including Airbnb Payments, Inc.). Alternatively, you may make a donation outside of the Airbnb Donation Platform without creating or logging in to your Airbnb account, by donating through PayPal (a “PayPal Platform Donation”). These Donation Terms only apply to Donations made through the Airbnb Donation Platform. PayPal Platform Donations may be subject to PayPal terms and conditions. Please refer to PayPal’s website for any applicable terms and conditions.
1.3 Term.
For One-Time Donations, you agree to these Donation Terms and the Airbnb Terms, effective as of the date you confirm your Donation . For Ongoing Donations, you agree to these Donation Terms, effective as of the date you first confirm a Donation Percentage (defined below).
1.4 Fees.
Airbnb Payments will send 100% of the Donation to Airbnb.org. Neither Airbnb Payments nor Airbnb.org charges any fees to you, nor does Airbnb Payments deduct fees from the Donation. Please consult the PayPal terms and conditions to determine whether PayPal will charge a fee or deduct a fee from your PayPal Platform Donation.
1.5 Donations Timeline for U.S. Residents.
For One-Time Donations, Airbnb Payments sends the Donation to Airbnb.org within 24 hours after you make a Donation. For Ongoing Donations, Airbnb Payments sends the Donation to Airbnb.org within 24 hours after Payout, subject to your Payout rules. For Donors in California, if you wish to learn when your Donation was received by Airbnb.org, please contact us at: 1-844-234-2500.
1.6 Eligibility.
Ongoing Donations are only available to Hosts in the United States, Argentina, New Zealand, Sri Lanka, Mexico, Japan, Malaysia, Thailand, Spain, United Kingdom, France, Italy and Germany. One-Time Donations are only available to Members in the United States, United Kingdom, France, Italy, Germany and Spain.
1.7 Tax Deductibility and Receipts.
You will receive a receipt either from Airbnb.org, or from Airbnb acting as an agent of Airbnb.org. For Donors paying income tax in the United States, Donations are tax-deductible to the extent allowable under United States tax law as a charitable contribution to Airbnb.org. Donations do not qualify for Gift Aid in the United Kingdom. Donations are not tax deductible in the European Union, and the receipts provided cannot be used for any tax deductions in your tax returns. For Donors who are fiscal residents of Mexico, Donations may be tax-deductible under the USA/Mexico Treaty to Avoid Double Taxation, when all applicable conditions are met. Donors should check their local tax regulations or seek professional tax advice to determine whether and to what extent their Donation qualifies for any tax benefit.
1.8 Data Sharing.
Your name, Donation and other personal information you submit in connection with any Donation may be disclosed to relevant tax authorities if required by applicable law. Your name, Donation and email address will be shared with Airbnb.org, which handles data in accordance with its privacy policy.
2. Ongoing Donations
2.1 Percentage.
As a Host, you may be given the option of donating a percentage of your future Payouts on an ongoing basis to Airbnb.org (“Donation Percentage”). This Donation Percentage will apply to all future Payouts due to you as the Host until you modify or cancel the Donation Percentage through your Airbnb account settings. The Donation is calculated as the Donation Percentage multiplied by the Payout due to you (after accounting for Host Fees and Taxes and/or any modifications to or cancellations of the reservation). For example, if you select a Donation Percentage of 20% and you are scheduled to receive a Payout in the amount of US$100, then at the time of the Payout, US$20 will be donated to Airbnb.org and the remainder (US$80) will be transferred to you via your chosen Payout Method in accordance with the Payments Terms.
2.2 Deduction From Payout.
By confirming a Donation Percentage, you authorize Airbnb Payments to do the following for each subsequent Payout: calculate the Donation, deduct it from the Payout, and send or make it available to Airbnb.org without any further confirmation from you. You may modify or cancel the Donation Percentage through your account settings up until the end of the business day before the next Payout is due to be initiated by Airbnb Payments, pursuant to Section 3.3 of the Payments Terms. Modifications to or cancellations of the Donation Percentage will not apply to any Payouts that have already been initiated or which are due to be initiated within the next business day. Once a Payout has been initiated, the Donation becomes payable to Airbnb.org and is non-refundable, and the Donation ceases to constitute a Payout under the Payments Terms. The remainder of your Payout will be paid to you via your chosen Payout Method in accordance with the Payments Terms. You will be able to see the Donation deducted from your Payout under your transaction history.
2.3 Modifications.
Should the charity receiving your Donations change such that it is no longer Airbnb.org, Airbnb will notify you of the change in advance and you may opt to cancel all future Donations to the new charity. If you do not cancel future Donations within that advance notice period, you will be deemed to have consented and instructed Airbnb to send the future Donations to the new charity.
2.4 Pausing
You may choose to pause your Donations for a set period of time in your account settings. When the pause has expired, Donations will automatically resume without further confirmation from you. You will be notified before your Donations resume.
2.5 Residents outside of the U.S.
The following applies if you are contracting with Airbnb Payments UK or Airbnb Payments Luxembourg: You acknowledge and agree that once a Donation becomes payable to Airbnb.org, you will not have any claim, right, title, or interest over the Donation and that you authorize Airbnb Payments UK or Airbnb Payments Luxembourg, as the case may be, to remit/transfer the Donation in such manner as may be necessary in order for such Donation to be received by Airbnb.org expeditiously.
3. One-Time Donations.
The amount donated to Airbnb.org is the amount you select and confirm through the Airbnb Donation Platform. Once you have confirmed and authorized the payment of the Donation through the Airbnb Donation Platform, the Donation then becomes payable to Airbnb.org and is non-refundable and cannot be modified.
